Custody Captain

Terms & Conditions

Last updated: September 17, 2026

These Terms & Conditions govern your use of Custody Captain, a rules-based custody and time-sharing calendar for co-parents. The service is operated by Pon De River Consulting, Inc. (trading as “Custody Captain”, “we”, “us”). By creating an account or continuing to use the service, you agree to these terms and confirm you are of legal age to enter into this agreement (or have authority to bind your organization).

The service

Custody Captain lets two parents build a repeating custody schedule from templates, layer holidays and one-off changes on top, share a view-only calendar, store parenting documents, and sync the schedule to phone calendars. We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you selected.

Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms (paddle.com/legal/checkout-buyer-terms). Subscriptions renew automatically at the interval you chose (monthly or yearly) until cancelled. New subscribers may start with a 7-day free trial; the first charge date is shown before you confirm and on your Plan page.

Acceptable use

You must not misuse the service. That includes:

  • Using the service for any unlawful purpose, fraud, or spam;
  • Infringing anyone's intellectual property rights;
  • Interfering with the service's security — including introducing malware, probing or scanning for vulnerabilities, or scraping the service;
  • Reverse engineering, reselling, or redistributing the service, or circumventing technical limits.

You are responsible for keeping your account credentials confidential and for all activity under your account, and for providing accurate information and keeping it up to date.

Your content

You retain ownership of the schedules, notes, and documents you add. You grant us a limited license to host and process that content solely to provide the service to you and the people you share it with.

Intellectual property

We retain all ownership of the service and its intellectual property, including the software, documentation, and Custody Captain branding.

Service level and warranties

We work hard to keep Custody Captain available, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, the service is provided “as is” and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Custody Captain is an organizational tool — it is not legal advice, and custody decisions remain yours and your court's.

Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill), and our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where the law does not allow it.

Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel your subscription at any time from your Plan page. When access ends, your data is handled as described in our Privacy Notice.

General

These terms are governed by the laws of the State of New York, and disputes will be resolved in the courts there, unless mandatory consumer law in your country says otherwise. You may not assign this agreement without our consent; we may assign it in connection with a merger or acquisition. We are not responsible for delays caused by events beyond our reasonable control.
